Alachua County deputies capture second suspect in killing of 'innocent bystander'

Alachua County Sheriff's deputies say they now have both suspects in custody in connection to a fatal shooting Sunday.

Deputies say 18-year-old Ty'Lek Scarborough turned himself into the jail at 1:22 a.m. He and his brother, 17-year-old James Scarborough, are both charged with first degree murder in the shooting death of Derrick Smith. James was taken into custody on Tuesday

Deputies say Smith, 24, was killed in a drive-by shooting at SW 67th Terrace in the Holly Heights neighborhood.

Sgt. Chris Sims says Smith was not the intended target. Deputies say the shooting is thought to be connected to a fight that happened earlier Sunday. He said the brothers were driving in separate vehicles at the time of the shooting. He said they both fired shots.

"It was later determined that our victim was actually a innocent bystander," Sims said.

Smith's girlfriend, who is pregnant with his child, said she heard the gunshots.

"I was in the house, I heard the gunshots from the apartment," she said. "I stay around the corner. And I come around here, my brother in law, his brother said my brother just got shot. I just seen my boyfriend on the ground."

Smith's mother says the shooting has left them distraught.

"Derrick didn't deserve this. Derrick did not deserve this," his mom said.
